Legal & Annuity Disclosures

These disclosures explain how fixed indexed annuity guarantees work, who stands behind them, how rollovers are completed, and which risks and alternatives should be reviewed before retirement assets move.

Effective August 11, 2026

Contractual protection is real—but contract specific. The issuing insurance company, not My Safe Rollover, provides every annuity guarantee. The complete issued contract, including its surrender schedule, withdrawal provisions, crediting formula, riders, exclusions and limitations, controls.

1. Status, operator and scope

“My Safe Rollover” is used on this website as a marketing and educational brand focused on eligible retirement rollovers and fixed indexed annuity concepts. The website receives requests for contact and coordinates appointments with persons who should be appropriately licensed for every regulated activity they perform. The brand name does not itself identify a particular insurer, bank, broker-dealer, registered investment adviser, trust company, employer plan, government office, law firm or accounting firm.

Nothing on this website represents that every visitor will be offered an appointment, qualify for an annuity, receive a recommendation or complete a rollover. Product availability, producer licensing, carrier appointments, minimum premiums, issue ages, underwriting or suitability review, state law and individual circumstances may limit what can be discussed or offered.

2. General education—not individualized investment, tax or legal advice

Website copy, videos, examples, interactive questions, frequently asked questions and appointment materials are general educational and marketing communications. They are not individualized investment, securities, tax, accounting, legal, ERISA, estate-planning or fiduciary advice. They are not instructions or a recommendation to buy, sell, surrender, exchange, replace, transfer or roll over any security, insurance product, retirement account or employee benefit.

A website visit, telephone call or form submission does not create an advisory, brokerage, fiduciary, attorney-client, accountant-client, insurer-insured or other professional relationship. No transaction should occur until the responsible licensed professional has obtained and evaluated the information required by applicable law and carrier procedures and the consumer has reviewed current plan, tax and contract documents.

3. Licensing, insurer appointments and product availability

Insurance products may be discussed, recommended or sold only through persons and entities holding the licenses and insurer appointments required for the applicable jurisdiction and product. A producer may offer only the insurers and product categories for which the producer is licensed and appointed. That product menu may not include every annuity, insurer, investment, plan option or strategy available in the marketplace.

Visitors should ask the responding person to identify the person’s role, license, states of authority, insurer relationships and available product categories. My Safe Rollover principally markets appointment-only service in Albuquerque, Los Lunas, Rio Rancho and surrounding New Mexico communities. Website availability elsewhere does not establish authority to transact business in another jurisdiction.

4. Annuity recommendations and New Mexico best-interest obligations

When a New Mexico insurance producer makes a recommendation of an annuity, 13.9.20 NMAC requires the producer to act in the consumer’s best interest under the circumstances known at the time, without placing the producer’s or insurer’s financial interest ahead of the consumer’s interest. The rule addresses duties of care, disclosure, conflict management and documentation.

Relevant consumer-profile information may include age, annual income, financial situation and needs, tax status, objectives, intended use, time horizon, existing assets and insurance, liquidity needs, liquid net worth, risk tolerance, financial experience and other required information. The producer should have a reasonable basis for the recommendation and communicate that basis. Refusal to provide material information may prevent a recommendation.

The insurance best-interest standard does not convert an insurance producer into a securities or investment adviser and does not require analysis of products outside the producer’s authority and license. Consumers should consult other qualified professionals when plan, securities, tax, legal or estate-planning issues are material.

5. A rollover is one possible choice

When a worker retires, changes jobs or otherwise becomes eligible to move assets, possible choices may include leaving eligible assets in the former employer’s plan, moving eligible assets to a new employer’s plan if accepted, using a direct rollover or transfer to an IRA, or taking a distribution. A partial rollover may also be available in some situations.

Material differences may include fees, investments, stable-value or institutional options, services, withdrawal rights, installment options, plan loans, required minimum distributions, creditor and bankruptcy protections, spousal rights, beneficiary rules, age-based exceptions to additional tax, employer-stock treatment, Roth and after-tax amounts, and the availability and cost of insurance guarantees. No single choice is best for every person.

Special facts can materially change the analysis. Employer securities, outstanding plan loans, required minimum distributions, domestic-relations orders, inherited accounts, after-tax contributions, Roth conversions, substantially equal periodic payments and public-sector benefits may require specialized plan, tax or legal advice.

6. Direct rollovers, trustee-to-trustee transfers and 60-day rollovers

A direct rollover or trustee-to-trustee transfer generally sends eligible assets to the receiving plan, IRA, custodian or insurer without paying the distribution to the participant. An eligible retirement-plan distribution paid to the participant is generally subject to mandatory 20% federal income-tax withholding even when the participant intends to complete a later rollover. To roll over the full eligible amount, the participant may need to replace the withheld amount from other funds.

A distribution paid to the participant generally must be rolled over within 60 days to qualify as a timely rollover unless an applicable waiver or exception is available. Amounts not properly rolled over may be taxable and may be subject to additional tax on early distributions. Different rules can apply to IRAs, Roth transactions, inherited accounts and non-eligible distributions. Confirm the exact transaction with the current plan administrator, receiving custodian and qualified tax adviser before requesting a check.

7. Fixed indexed annuity contractual guarantees

A fixed indexed annuity is a long-term insurance contract issued by an insurance company. Depending on the contract, written guarantees may include a minimum contract value or minimum interest provision, protection against negative index interest, a death benefit, annuitization options or lifetime-income benefits. Exact guarantees, calculation methods, exclusions and conditions vary by contract.

Every guarantee is an obligation of the issuing insurance company and is subject to the company’s claims-paying ability and financial strength. My Safe Rollover does not guarantee an insurer, contract value, interest credit, income payment or tax result. Independent financial-strength ratings are opinions at a point in time, can differ among rating organizations and can change. A rating is not itself a guarantee and should not be the only basis for a purchase.

Annuities are not bank deposits, savings accounts or certificates of deposit. They are not insured by the Federal Deposit Insurance Corporation or National Credit Union Administration and are not guaranteed by a bank or federal agency.

8. Index-linked interest, floors and limits

A fixed indexed annuity is not a direct investment in a stock or market index. The owner does not receive dividends and does not own index shares. An external index is used in a contract formula to calculate interest, if any, for a crediting period.

Under an applicable fixed indexed crediting strategy, the index-crediting rate generally will not be less than zero solely because the referenced index declines. That index floor does not mean the contract can never decline. Withdrawals, surrender charges, market-value or interest adjustments, rider or contract charges, annuitization, required distributions and taxes may reduce value or benefits.

Caps, participation rates, spreads, margins, volatility controls, declared rates, allocation restrictions and other factors can limit credited interest. Non-guaranteed factors may change as permitted by the contract. Past index performance does not predict future credited interest, and the contract may earn no index interest during a crediting period.

9. Liquidity, surrender periods, withdrawals and market-value adjustments

Fixed indexed annuities are designed for long-term retirement money. Contracts commonly include a surrender period during which withdrawals above a stated free-withdrawal amount may incur a surrender charge. The charge usually declines over time, but the schedule varies.

A contract may also apply a market-value adjustment or interest adjustment that can increase or decrease a withdrawal or surrender value based on interest-rate or other contract conditions. Withdrawals may reduce the contract value, death benefit, income base, future income or other benefits. Required minimum distributions may receive special treatment under some contracts, but exact provisions must be confirmed.

Emergency access, nursing-home or terminal-illness waivers may be available under some contracts, subject to eligibility, state approval and documentation. These features should never be assumed unless they appear in the applicable contract or endorsement.

10. Annuities inside IRAs and other tax-qualified arrangements

An IRA, 401(k), 403(b), TSP or other tax-qualified arrangement already provides tax deferral under applicable law. Placing an annuity inside an IRA or other tax-qualified arrangement does not create additional tax deferral. The annuity should be evaluated for other contract features, such as principal protection, index-linked interest, income options or beneficiary provisions, after costs, restrictions and alternatives are considered.

A rollover generally defers rather than eliminates tax. Distributions are taxed under the rules applicable to the account and transaction. Roth conversions or movement between pretax and Roth arrangements may create current taxable income. Taxable withdrawals before age 59½ may be subject to additional federal tax unless an exception applies. Consult a qualified tax professional.

11. Lifetime-income riders, annuitization and beneficiary provisions

Depending on the contract, guaranteed lifetime income may be available through annuitization or an optional income rider. A rider may have a separate charge, waiting period, age requirement, withdrawal percentage, benefit-base formula and restrictions. A benefit base used to calculate income is generally not the same as cash surrender value and may not be available as a lump sum.

Lifetime withdrawals may reduce contract value and the amount remaining for beneficiaries. Death-benefit provisions, spousal continuation, beneficiary payout methods, rider continuation and required-distribution treatment vary by contract. Review how income and legacy goals interact before selecting a feature.

12. Replacements, exchanges and loss of existing benefits

Replacing or exchanging an existing annuity can restart a surrender period, create new charges, cause loss of guarantees or benefits, change death or income provisions, create tax consequences and generate new producer compensation. Existing contracts may contain favorable rates, riders, benefit bases or grandfathered provisions that cannot be recreated.

Before replacement, compare the old and proposed contracts side by side, including surrender value, surrender period, current and guaranteed rates, crediting methods, rider costs, income and death benefits, tax basis, insurer strength and the reason the new contract is expected to improve the consumer’s position. Required replacement forms and insurer review do not eliminate the consumer’s need to understand the transaction.

13. Compensation, insurer relationships and conflicts

A licensed insurance professional may receive commissions, renewals, bonuses, non-cash compensation, marketing support or other compensation from an insurer or intermediary if an annuity is purchased or maintained. Compensation may vary by product, carrier, premium, contract duration and other factors. The responding professional may have relationships with only a limited group of insurers and may not offer securities, mutual funds, bank products, employer-plan advice or every available annuity.

Consumers should ask how the professional and any marketing organization are compensated, which insurers and product categories can be offered, what material conflicts exist and whether another professional will participate. Required producer-relationship, product, replacement, conflict and compensation disclosures should be reviewed before or at the time required by law and carrier procedure.

14. How “safe,” “protected” and “guaranteed” are used

On this website, “safe” and “protected” refer to contractual features available in certain fixed and fixed indexed annuities, including protection from negative index interest under applicable crediting strategies and other guarantees stated in the issued contract. The words do not mean that every rollover is appropriate or that an annuity is free from every risk.

“Safe” does not mean fully liquid, free from surrender charges, protected from inflation or opportunity cost, immune from insurer credit risk, free from tax consequences, or insured by the FDIC, NCUA, a bank or the federal government. “Guaranteed” refers only to a specific obligation stated in the contract and supported by the issuing insurer’s claims-paying ability.

15. Video, examples and third-party content

The featured Vimeo video and any other third-party content are general educational or marketing communications. They may simplify complex subjects and may not describe every exception, cost, risk or contract term. A video does not replace carrier-approved materials, a consumer-profile review, an insurer illustration, plan documents or the issued contract.

Any testimonial or personal story later added reflects the speaker’s individual experience and opinion and does not promise that another person will receive the same experience or result. Material compensation or relationships connected with a testimonial should be disclosed where applicable.

16. No government, employer or plan endorsement

My Safe Rollover is not affiliated with, authorized by or endorsed by the Internal Revenue Service, Social Security Administration, Medicare, U.S. Department of Labor, Securities and Exchange Commission, FINRA, Federal Deposit Insurance Corporation, National Credit Union Administration, New Mexico Office of Superintendent of Insurance, any employer, union, retirement plan, plan administrator, custodian or government agency. References to public rules or resources are educational and do not imply endorsement.

17. Appointment requests, calls, texts and sensitive information

The appointment form requests only basic contact and topic information. Do not submit Social Security numbers, account or routing numbers, passwords, login credentials, tax returns, medical information, full dates of birth or financial statements. Ordinary website forms, email, calls and text messages are not appropriate for highly sensitive information.

Submitting the form with the authorization box checked permits My Safe Rollover and an appropriately licensed insurance professional responding to the inquiry to contact the visitor at the supplied phone number or email regarding appointment scheduling, retirement rollovers and fixed indexed annuity insurance products. Consent is not a condition of purchase. Message and data rates may apply. The authorization does not approve a transaction, establish suitability or create a recommendation.

18. Website accuracy, changes and controlling documents

Reasonable care is used in preparing website content, but laws, tax rules, plan terms, insurer ratings, rates, product features, carrier appointments and professional licenses can change. No representation is made that every page is complete, current for every visitor or free from error. Current statutes, regulations, plan documents, carrier-approved materials and the issued contract control over a website summary.
